General conditions of sale – FINE FOOD GRINDER

    Premise

All commercial relationships between MACINO FINE FOOD and customers are governed exclusively by the following general conditions of sale, excluding any other agreement, unless agreed in writing. Placing an online order implies full acceptance of the following conditions.

There are alcohol and products containing alcohol on the site. These, according to current regulations, can only be purchased by adults. By placing these items in the cart the customer confirms that they are of legal age for the consumption of alcohol.

2 Technical Information

The technical information included on the website is https://macino.simply.site/ obtained from the information published by the manufacturers of the goods included in our catalogue. Macino fine food reserves the right to modify/adapt the technical and dimensional information of the products in the catalogue, based on what will be communicated by the producers, even without any prior notice; except for orders already submitted and accepted.

    Orders

Orders can only be placed online. The customer who sends the order via the Internet will receive, at the end of the procedure, a communication confirming that the order proposal has been inserted into our information system. Confirmation of acceptance of the order or rejection of the same (for accounting, administrative reasons or product shortage) arrives at a later time via electronic mail (E-mail). When completing the First Order there are mandatory fields to fill in; when returning to our Site (as a Registered User) it will be sufficient to enter the UserID and Password to view your data and possibly modify them. The responsibility for managing the UserID and Password lies exclusively and strictly with the customer.

    Prices

All prices listed on the site are VAT included. List prices and discounts can be modified at any time, without notice except for orders already accepted.

    Product availability

Macino fine food does not guarantee the certainty of assignment of the ordered goods until the order itself is accepted and the acceptance communicated to the customer.

    Shipping and deliveries

Shipments, unless otherwise agreed, will be carried out by transporters defined by Macino fine food. In this case, the goods travel at the risk of Macino fine food. In the event of theft/loss confirmed by the carrier, Macino fine food undertakes to send a new product and, should it be unavailable and/or out of stock, it will propose a different product, but with equivalent characteristics, with the right to customer not to accept this new product and request the issuing of a credit note relating to the product itself. The list prices do not include transport, handling or installation costs of the goods. In the event that the carrier is appointed, in any capacity, by the customer, Macino fine food will not be responsible for the loss and/or damage of the product from the moment of delivery of the goods to the carrier at its warehouses. Shipping costs will be calculated when completing the order. Deliveries that make exceptional and ancillary services essential must be strictly agreed upon at the time of the order; therefore no dispute in this regard will be accepted subsequently. Upon receipt of the goods, even in the presence of intact packaging, the customer is required to immediately ascertain the conformity of the goods with the purchase order placed. In particular, he must verify the integrity of the goods and the quantitative and qualitative correspondence with what is indicated in the order and in the accompanying document. In case of apparent discrepancies or defects in the products, these must be reported upon receipt of the same, at which time the customer is asked to carefully inspect what has been received. Any report made in different ways will not be taken into consideration. The customer will be liable for any damage resulting from false reports and declarations.

    Payments

Terms of payment:

Pay Pal, Credit Card, Bank Transfer The products ordered by the customer will be kept busy until proof of the bank transfer is received, to be sent to Bono Srl via e-mail no later than 24 hours from the date of acceptance of the order. The order will be sent only when the amount due is actually credited to Macino fine food's current account, which must take place within 7 working days from the date of acceptance of the order. Once these deadlines have passed, the order will be considered automatically cancelled. The reason for the bank transfer must include: - the order reference number; - name and surname of the order holder. For each order placed, Macino fine food issues a receipt or invoice for the material shipped, sending it via e-mail to the order holder or allowing it to be downloaded from the site. No changes to the invoice will be possible after it has been issued.

    Right of withdrawal

The right of withdrawal consists in the possibility for the consumer to withdraw, within fourteen working days, from any purchase made remotely and receive a full refund of the expense incurred for the purchase without any penalty. However, the right of withdrawal is excluded in the following cases, pursuant to art. 55 Legislative Decree 21/2014: - order of tailor-made or clearly personalized products; - order of products that risk deteriorating or expiring rapidly; - order of sealed products that are not suitable for return for hygienic or health protection reasons or which have been opened after delivery. With reference to the cases of exclusion of withdrawal listed above, the customer, in particular, is informed and accepts that among the products that "risk deteriorating or expiring rapidly" include all food products (including fresh, packaged food products, wines, spirits and drinks) as the characteristics and qualities of these types of products are subject to alteration also as a result of inappropriate conservation. Therefore, for hygiene and customer protection reasons, the right of withdrawal is not applicable to products sold by Macino fine food. Likewise, non-consumer customers who purchase with a VAT number cannot under any circumstances exercise the right of withdrawal.

    Exclusion of product returns due to hidden defects

Given the particularity of the goods sold by Bono Srl, the product is accepted by the customer in the state of fact and in the conditions in which it is found at the time of acceptance of these conditions ("seen and liked" clause) and it is not possible to report the occurrence of hidden defects, nor request the related refund.

    Limitations of Liability

Macino fine food cannot under any circumstances be held responsible towards the customer, except in the case of willful misconduct or gross negligence, for disservices or malfunctions connected to the use of the internet beyond its control. Furthermore, Macino fine food will not be responsible for damages, losses and costs suffered by the customer following failure to execute the contract for reasons not attributable to him, the customer having the right only to a possible full refund of the price paid.

    Major force

Macino fine food cannot be held responsible for the failure or delay in fulfilling its obligations due to circumstances beyond the reasonable control of Macino fine food itself due to events of force majeure or in any case to unforeseen and unforeseeable events independent of its will. The fulfillment of its obligations by Macino fine food will be considered suspended for the period in which force majeure events occur. Macino fine food will carry out any action in its power in order to identify solutions that allow the correct fulfillment of its obligations despite the persistence of force majeure events.

The website may contain links to third-party sites/applications. Bono Srl has no control over them and, therefore, is in no way responsible for their contents.

    Protection of personal data

With regards to all obligations and information relating to the processing of the organisation's personal data and the related purposes, please refer to the specific information contained on the website, where the cookie policy can also be consulted. In any case, please remember that pursuant to art. 130 of Legislative Decree 196/2003, so-called privacy code, as amended by Legislative Decree 101/2018, the processing of personal data for commercial purposes through the use of electronic mail can be legitimately carried out provided that the postal coordinates electronic messages are those provided in the context of the sale of a product or service, provided that they are messages sent for the purpose of direct sales of products and/or services provided by the data controller, provided that they are services similar to those covered by the sale and provided that the interested party, adequately informed, does not refuse such use initially or on the occasion of subsequent communications and provided that the possibility is guaranteed for the interested party to ''oppose the processing at any time, in an easy and for free'' (so-called soft spam). Therefore Macino fine food will legitimately proceed with sending commercial emails having as their object the offer/promotion of services similar to those previously provided to its customers.

    Applicable law and dispute resolution

The General Conditions of Sale are governed by Italian law and in particular, for the Consumer User, by legislative decree 6 September 2005 n. 206 (Consumer Code) with specific reference to the legislation regarding distance contracts and the legislative decree of 9 April 2003 n. 70 on certain aspects concerning electronic commerce. All disputes arising from this contract will be referred to a conciliation attempt at the mediation body of the Udine Chamber of Commerce and resolved according to the conciliation regulations adopted by the same. If the Parties intend to appeal to the ordinary Judicial Authority for any dispute relating to the validity, interpretation or execution of these General Conditions of Sale, the territorial jurisdiction lies with the judge of the place of residence or domicile of the consumer. The Consumer User resident in Europe declares to be aware of the fact that the European Commission has established - to resolve disputes with companies extrajudicially arising from purchases of goods and services made online or through online markets.

    Postponement

This contract is regulated by the Italian law. For anything not expressly provided here, the laws applicable to the relationships and cases envisaged in this contract apply, and in particular the art. 6 of Regulation (EC) no. 593/2008 of the European Parliament and of the Council, of 17 June 2008, on the law applicable to contractual obligations (Rome I Regulation). Pursuant to art. 60 code cons., the regulations contained in Part III, Title III, Chapter I of the code are expressly referred to here. cons. These conditions are updated as of 01/03/2023 and may be modified, without notice, without prejudice to orders already accepted.

Pursuant to and for the purposes of art. 1341 and 1342 cc, the customer, after having taken careful and specific knowledge and vision, expressly approves and accepts the following clauses: n. 8; n. 9.new paragraph.
